FORTVISION, together with its affiliates ("FORTVISION", “we”, “us”, or “our”), recognizes the importance of privacy. In this privacy policy ("Privacy Policy") we describe how we collect, use, and disclose information that we obtain through our website, www.FORTVISION.com or any other FORTVISION website and app displaying this Privacy Policy (collectively, the “Sites”), as well as our platform, widget, analytics tool, and other technical applications that we may provide either through our Sites or through third-party websites (collectively, the “Services”). By visiting the Sites, using or interacting with any of our Services, you expressly consent that any information that we collect from or about you through our Sites or Services, including Personal Information, anonymous information, and aggregate information (collectively, “Information”), will be handled as described in this Privacy Policy.

The use we make of the Information, including Personal Information, collected through the Sites and Services may vary depending on whether you are (i) a FORTVISION customer ("Customer"), i.e., a publisher, eCommerce site, Game app, advertiser, or other provider with whom we have a contractual relationship; (ii) a visitor of our Customers' websites who interacts with our Services ("User"); or (iii) or a visitor of our own FORTVISION Sites ("Site Visitor"), which may include Customers as well as prospective customers. Therefore, we have distinguished the relevant information that relates to each of these target categories into three different sections below. Information that is relevant to all of these three categories is set forth in Section 4 of this Privacy Policy.

We define “Personal Information” to mean personally identifiable information about an individual, such as a name, company details, address, email address, phone number, or other identifier that permits direct or indirect identification of a specific individual, or as otherwise defined by applicable privacy and data security laws.

Your use of our Sites or Services, and any dispute over privacy, is subject to this Privacy Policy and our Terms of Use, including its applicable limitations on damages and the resolution of disputes. Customers

We collect Customer Information directly from our Customers. For example, we will collect Customers’ user name and password, as well as contact details if a Customer creates an account on any of our Sites. When a Customer sends us an email asking a question, or signs up to our email newsletters, we will collect the Information that the Customer submits to us. We will also collect other Information that Customers choose to provide to us, such as the contents of a message that a Customer submits through our Sites.

When a Customer uses our Editor platform, we collect Information such as the Customer's name, email address, telephone number, company name, payment card information, billing information, and any other Information the Customer may choose to provide to us on the platform.

How We Use & Disclose Customer Information
We use Customer Information for the following purposes:
Providing our Service. To provide our Sites and Services and for other customer service purposes in relation to Customer accounts.
Communicating with you or others. To communicate with Customers, including via email, about the Customer’s account; to respond to Customer inquiries or complaints; to provide Customers with news, best practices or other information we think may interest them.
Marketing and advertising. To provide Customers with newsletters, special offers, and promotions, including via email; to contact Customers about products or services we think may interest them; and for other marketing, advertising, and promotional purposes.

We may disclose Customer Information as follows:
FORTVISION affiliates. We may disclose Customer Information to any current or future affiliates, parent companies, or subsidiaries.
FORTVISION service providers. We may disclose Customer Information to vendors, service providers, agents, contractors, or others who perform functions (e.g., maintenance, data analysis, customer relationship management, email marketing, surveys, credit card processing, data hosting, fraud detection) on our behalf.
Customers. We may disclose Customer Information to other Customers. For example, we may provide publishers with information about what advertisers may appear on their network or advertisers with information about which publishers they have appeared on.

Customers may verify, correct, or update the Personal Information they have provided to us by updating the Personal Information in their account, by emailing their dedicated account manager or by emailing us at support@FORTVISION.com. Customers may also request the deactivation of their account by emailing us at support@FORTVISION.com. We may send periodic promotional or informational emails to Customers. Customers may at any moment opt out of such communications by following the opt-out instructions contained in the email. Please note that it may take up to ten (10) business days for us to process opt-out requests. If Customers opt out of receiving emails about recommendations or other information we think may interest them, we may still send them emails about their account or any Services they have requested or received from us. If a Customer is an EU resident, we will only send the Customer periodic promotional or informational emails provided the Customer is a Customer (i.e., not a prospect), has provided the email address of a legal person to receive our promotional communications, or if the Customer has opted in to receive such communications from us.

Users

We collect User Information automatically through a User’s use of or interaction with our Services. We automatically collect Information through a User’s use of our Services through cookies and other technologies, like most other web-based services. This Information may include, without limitation, information about a User’s operating system, IP address, battery status, GPS location, ISP, the webpages accessed by Users within our Customers’ websites, the link that led a User to a Customers' website, the dates and times a User accesses a Customers' website, event information (e.g., system crashes), and general location information (e.g., city and state).

How We Use & Disclose Users Information
Providing our Service. To provide our Services to Users and our Customers.
Tailoring content. To tailor the content and information that we may send or display to Users; to retarget content or products to Users through our Services and elsewhere; and to otherwise personalize your experiences while using our Services.

Tailoring content across multiple devices. To improve a unique User’s experience across multiple browsers and devices (such as smartphones, tablets, or other viewing devices) by providing better targeted ad campaigns to that User. For instance, we may usually recognize a User on a web browser, and may want to provide similar content through mobile apps, as well. To do this, we identify unique Users across devices, or we may sync cookies and identifiers with our service providers or Customers that do this, to help our Customers enhance their own data and data segments, or help them obtain or provide customer insights to other marketers.

We may disclose User Information as follows:
FORTVISION affiliates.We may disclose User Information to any current or future affiliates, parent companies, or subsidiaries.
FORTVISION service providers. We may disclose User Information to vendors, service providers, agents, contractors, or others who perform functions (e.g., maintenance, data analysis, customer relationship management, email marketing, surveys, credit card processing, data hosting, or fraud detection) on our behalf.
Unaffiliated third parties. We may disclose User Information to other unaffiliated third parties, such as our Customers.
Customers. We may disclose User Information to Customers. For example, we may provide our customers with information about the viewing and click-through patterns of postings of the content they publish and may provide advertisers with information to inform them about conversion rates for analytics purposes.


Interest-Based Advertising
Through our Services, including our Services on Customer Websites, we may provide advertisements to you based on your recent browsing behavior across different Customer Websites, browsers, or devices. For example, if you visit and browse on Website A on a first online visit, on a subsequent online visit to Website B, you may see content personalized based on your browsing history on Website A. In order to target advertisements to you for products and services in which you might be interested, we may use cookies, JavaScript, web beacons (including clear GIFs), HTML5 local storage and other technologies. We may also use third parties such as network advertisers, which are third parties that display advertisements based on your visits to websites you have visited to target advertisements to you for products and services in which you might be interested. Third-party ad network providers, advertisers, sponsors and/or traffic measurement services may also use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs and other technologies to measure the effectiveness of their ads and to personalize advertising content to you. FORTVISION supports initiatives of greater transparency and control for users, and offers the following options for controlling the interest-based content and ads you receive.
If you do not want to receive interest-based ads displayed by FORTVISOIN, you can disable the display of such ads by visiting our website www.FORTVISION.com and click on the opt-out button.
Because our tracking mechanisms operate at the device and browser level, to fully opt-out across devices, you will need to do so on each device and browser individually.
Please note that opting out will not prevent you from seeing our Services on our Customers' websites, but it will affect the types of ads that you will see. These ads will no longer be tailored to your interests and instead will be chosen based on the particular website that you are viewing (i.e. contextually based ads).
We retain identifiable data, which is directly collected for purposes of serving ads, for one year from the User’s last interaction with our Services, after which time we de-identify the data by removing unique identifiers or aggregating the data.
We retain aggregated data, which can not identify an individual or device and is used for purposes of reporting and analysis, for as long as commercially necessary. We keep opt-out information for longer than this period so that we can continue to honor opt-out requests.


Children
We do not knowingly collect any data or target an advertisement on a website directed towards on a website directed to children under the age of thirteen (13). Site Visitors

We collect Site Visitor Information directly from you or from third parties who collect Site Visitor Information automatically through your use of our Sites. We may combine all of the Information we collect from various sources.

Information we collect directly from you. We may collect Site Visitor Information directly from you. For example, when you send us an email asking a question, or submit a form on our Sites to receive marketing materials or email newsletters, we will collect the Information that you submit to us. We will also collect any other Information that you choose to provide to us, such as the contents of a message that you submit through our Sites.

The Information we collect from Customers, Users and Site Visitors are used for the purposes as respectively set forth in the sections above, as well as for the following purposes:
Analyzing use of our Services. To better understand how Customers, Users, Site Visitors access and use our Site and Services, both on an aggregated and individualized basis; to respond to Customers’, Users’, and Site Visitors’ desires and preferences; and for other research, analytical, and statistical purposes.
Legal compliance. To comply with applicable legal obligations, including requests from law enforcement or other governmental entities.
Protecting our rights and interests. To protect our rights and interests and the rights and interests of our Customers, Users, Site Visitors, and the general public, as well as to enforce this Privacy Policy and our Terms of Use.

When we disclose your Information with third parties, we require such recipients to agree to only use the Information we share with them in accordance with this Privacy Policy and for no other purpose than those determined by us in line with this Privacy Policy.
In addition to the disclosures detailed above, we may also disclose Information for the following purposes:

We reserve the right to disclose and/or transfer Information to another entity if we are acquired by or merged with another company, if we sell or transfer a business unit or assets to another company, as part of a bankruptcy proceeding, or as part of any other similar business transfer.

Our Sites and Services may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Privacy Policy but instead is governed by the privacy policies of those third-party websites. We are not responsible for the information security nor privacy practices of such third-party websites.

Security Of Your Information

We maintain tight controls over all the data we collect, retaining it in firewalled and secured databases with strictly limited and controlled access rights, to ensure it is secure. Please be aware that the information collected is being transferred to, stored and processed in Europe and in the United States where our servers are located and our central database is operated by Microsoft Azure and Amazon. Please remember that unfortunately, the transmission of information via the internet is not completely secure, so although we will do our best to protect the data, we cannot guarantee the data security transmitted via the Product. Any transmission is at your own risk.

The Product performs regular checks for updates and may download such updates when needed.

Others

With the prior permission from our advertiser Customers, we may place a pixel tag on their website. Pixel tags (also known as web beacons or clear GIFs) are typically transparent graphic images placed on a website. These pixels are used in combination with cookies to measure the actions of visitors to their websites that arrive through the Services. For example, we may use pixel tags to track conversions or to create a custom audience for our advertiser Customers to target on our network (i.e. retargeting).

Data

Cookies used on our Sites: The information we receive from our trusted business partners placing third-party cookies on our Sites. We may also use third parties who collect Information about Site Visitors through their own cookies, web beacons, and other technologies regarding your online activities, either on our Sites and/or other websites across the Internet, in an effort to understand your interests and deliver you advertisements that are tailored to your interests.
Cookies used through Services: The information that we collect via cookies may include, for example, information about your operating system, the webpages accessed within the websites of our Customers, the website that led you to our Customers' websites, the dates and times you accessed our Customers' websites or platforms, event information (e.g. system crashes), and general location information (i.e. city).




We use the information collected via third party cookies on the Sites to remember your information to prevent you from having to re-enter it during your next visit to our Sites, to see how you visit various sections of the Sites, to monitor how many visitors we have on our Sites and which webpages have been viewed, and to improve and manage the Sites. We may use third parties to track and/or analyze your activity on the Sites, or to deliver you advertisements that are tailored to your interests.
